We understand that our clients have globalised portfolios, and so their property at the time of death may be located in several jurisdictions.

This means that more individuals will require coordinated estate administration using multi-jurisdictional wills and separate situs wills (that is, wills concerning assets located in one legal jurisdiction and typically executed in that jurisdiction by its law.

Modern family structures

A move away from the traditional nuclear family can create added complexities when it comes to the administration of estates.  This may include online trust administration and potential claims against the estate.

Under the Inheritance Act, spouses and civil partners and ex-spouses /civil partners form two of the categories of people permitted to make a claim. So, when somebody dies leaving behind a person in those categories if they have not made ‘adequate’ provision for them, a claim can be made against their estate.
