After years of family law lawyers, experts and many others campaigning across the country, some good news! From the 6th of April 2022, people seeking to get a divorce will no longer have to assign blame to go ahead with divorce proceedings.

This means that, as opposed to having to give one of five facts before you can start the divorce process and having to wait two years, you can divorce your ex-partner on your terms without creating animosity.

‘No Fault’ divorce takes sting out of proceedings

In the past, both parties had to lay the blame for the breakdown of the marriage at the other person’s feet.

Each of the five reasons for divorce can put couples wanting to move on into an unpleasant situation.

If you don’t want to blame each other and are on good terms with your ex-partner, you previously had the option of waiting two years to divorce, rather than citing one of the following reasons:

  • Unreasonable behaviour
  • Adultery
  • Desertion

Waiting the two years to issue divorce proceedings is a long time, especially when you’re ready to finalise matters and move on.

The ‘no fault’ divorce eliminates that and allows couples to divorce on their terms and move in the right direction.

Can I still get an online divorce?

The online divorce portal has been a hugely welcome development that has reduced waiting times and expedited the divorce timelines by eliminating the time it takes to file traditional paper documents.

Her Majesty’s Courts and Tribunal Service (HMCTS), like many of us, is keen to make sure that this system keeps running smoothly. The date of the 6th April 2022 will give HMCTS plenty of time to prepare and ensure that the no fault divorce can run smoothly when it’s implemented.
