What Has Been Announced?

Yvette Cooper confirmed that new applications under the refugee family reunion route will be suspended, with the government intending to introduce a new framework later this year. This move is part of a broader overhaul of the UK’s asylum system, stated to be aimed at reducing small boat crossings and addressing the use of asylum hotels.

While the exact date of implementation is not yet confirmed, we expect a Statement of Changes to the Immigration Rules this week, and the suspension may take effect immediately.

This change means that refugees will, for the time being, be subject to the same family migration rules as other migrants, including Appendix FM, which imposes stricter requirements such as a minimum combined income threshold of £29,000.

Is There Still Time to Apply?

Yes, if you act quickly. It is still possible to apply under Appendix Family Reunion (Sponsors with Protection) before the suspension formally takes effect. This route allows pre-flight partners and dependent children of individuals with protection status in the UK to reunite without needing to meet the financial, accommodation, or English language requirements that apply under Appendix FM.

What Happens After the Suspension?

Once the suspension is in place, Appendix FM will remain available for family members of refugees. While this route is more demanding, it does allow for fee waivers and exemptions from financial and accommodation requirements in certain circumstances, particularly where Article 8 of the European Convention on Human Rights (right to family life) is engaged.
