Can I get legal aid for divorce in the UK?
Legal aid for divorce is only available in England and Wales if you can provide evidence of domestic abuse and fall below the required means testing.
If you are in immediate danger, you may qualify for means-tested Legal Aid to apply for a Non-Molestation Order. Our dedicated team in Liverpool can help you gather the necessary evidence and guide you through the process.
If you can evidence domestic abuse and have a low income or in receipt of benefits, you may also be eligible for Legal Aid to cover your divorce or civil partnership dissolution. Speak to our team, we’ll assess your eligibility and support you every step of the way.
What if I can’t prove domestic abuse?
If you don’t meet the criteria for Legal Aid, you may still be able to reduce or eliminate the £612 divorce court fee through the Governments Help With Fees scheme.
You could qualify if you:
- Receive benefits like Universal Credit, Income Support, or Pension Credit
- Have a low income and limited savings (under £4,250, or under £15,999 if over 66)
Even if you don’t receive benefits, you may still qualify based on your income. For example, you can get money off your fee if your reported income is:
- £1,420 or less, if you’re single
- £2,130 or less, if you have a partner
You can also add child you have, your reported income can be:
- £425 more for each for child aged 0 to 13 and £710 for children aged 14 and over
Do I need legal advice if we have no assets?
Yes. Even if you and your partner have no significant savings or property, it’s crucial to legally separate your finances.
Without a formal agreement, your ex could make a claim against your future assets, even years later.

Will I have to repay Legal Aid if I receive money in the divorce?
Possibly. If your legal fees were covered by Legal Aid and you later receive a financial settlement, you must inform the Legal Aid Agency.
They may ask you to use part of your settlement to repay your legal costs.
