The Case Background

Our client and his brother inherited a commercial property following the passing of their parents. The property had been occupied for several years by a tenant who, despite remaining in the premises, had not paid rent for a significant period of time. The tenant also refused to sign a new lease, leaving our client in a difficult legal and financial position.

Initially, the tenant expressed interest in purchasing the property. However, after months of discussions and delays, it became clear that he had no intention of following through with the sale. This left the property in limbo, occupied, but without any formal legal agreement or generative income.

The Legal Challenge

With no rent being paid and no lease in place, our client was left with limited options. The situation was further complicated by the tenant’s refusal to engage constructively. It was clear that decisive legal action was needed to recover possession of the property.

We advised our client on the legal steps required to proceed with eviction. This included serving the appropriate notices to the occupier, ensuring all procedural requirements were met to avoid any potential legal challenges.

What Action’s Did We Take? 

Once the notice period had expired and no resolution had been reached, we instructed High Court Enforcement Officers (Shergroup) to carry out the eviction. The operation was conducted early one morning, with the officers changing the locks and securing the premises.

Throughout this process, we ensured that all legal obligations were fulfilled. Notices were left on the premises, and the eviction was carried out in a professional, ethical and lawful manner.

The Outcome

Thanks to our thorough preparation and strategic approach, our client successfully regained possession of the property. The occupier has not returned to collect his belongings and has made no attempt to re-enter the premises.

This outcome provided our client with peace of mind and the freedom to move forward whether that meant re-letting the property, selling it, or redeveloping it for future use.
